It is quite common for INDECOPI (the Peruvian Trademark Office) to deny registrations of trademarks that they consider identical or substantially similar to other previously registered trademarks.

This denial means a loss of time for the applicant: between three to four months, but also money, since he has lost the US$ 144.00 that he has to pay INDECOPI to request the registration of a trademark and also the amount that he has surely paid to a graphic designer to design the trademark that he so longed to register.

To reduce the chances of a trademark being denied, it is always advisable to conduct a trademark search before filing a trademark application.

The trademark search consists on reviewing the INDECOPI trademark database, where all the trademarks duly registered in Peru appear. By reviewing this database, one can see if the proposed trademark is identical or substantially similar to any of the trademarks that are already registered in the country.

If my trademark has substantial similarities with another trademark that is already registered for the same or similar goods, then I could modify the design of my trademark to reduce the chances of it being denied.

A trademark search allows me to evaluate the chances of my trademark being registered before INDECOPI, preventing me from wasting time and money filing a trademark application that has no chance of being granted.
